Acceptance of Terms
These Terms of Service govern the contractual relationship between you and Mahmoud El-Gamal for using the haiati platform. By registering an account or using the platform, you agree to these Terms of Service in the version presented.
Our Services
haiati is a multilingual online platform for the Arabic-speaking community in Europe and Egypt. It comprises five modules: service provider directory (including neighborhood endorsements, short-term deals without strikethrough price comparisons, and neighborhood help requests), marketplace for goods, job board with application feature, community events, and community questions & answers (Q&A) along with direct messaging. haiati acts solely as a technical intermediary and hosting service provider: contracts for services, sales, employment, or events are concluded exclusively and directly between the participating users, businesses, and organizers; haiati does not become a party to those transactions.
Minimum age
You must be at least 16 years old to create an account on haiati; if your habitual residence is in Egypt, you must be at least 18 years old (full legal capacity). By registering, you confirm that you meet the minimum age applicable to you and accept these Terms of Service in the version shown.
User Obligations
You agree to provide truthful and complete information when registering and in your profiles, listings, job postings, and events, to keep your login credentials confidential, and to maintain at most one personal account. If you wish to invite a business to join haiati, you may do so only via a personal invitation link that you share yourself through an existing contact; sending unsolicited promotional or invitation messages in haiati’s name is prohibited. Anyone offering goods or services on haiati on a commercial or professional basis is solely responsible for complying with all applicable trade, tax, professional, and consumer protection disclosure and imprint obligations.
Moderation of content
We review content before or after publication using a combination of automated text pre-screening and human moderation to prevent illegal content and violations of these Terms of Service (Articles 14 to 20 DSA). The automated filter may temporarily hold content for review; every decision to restrict visibility, hide, or remove content or to suspend an account temporarily or permanently is made by a human. Affected users receive a statement of reasons under Art. 17 DSA indicating the legal ground or terms clause violated. Anyone can report suspected illegal content without an account via our notice form (Art. 16 DSA). If you disagree with a moderation decision (restriction, removal, account suspension, or rejection of a notice), you can submit a free complaint within six months of notification via our internal complaint-handling system (Art. 20 DSA) at the contact address below; a human will review the decision anew. You may also turn to a certified out-of-court dispute settlement body under Art. 21 DSA or the competent supervisory authority (KommAustria), without prejudice to your right to seek redress before the courts at any time.
Rules for content
These rules apply to all content. Content that breaks them can be restricted or removed under the moderation above. Notices and decisions refer to these clauses.
Fraud or deception
Content meant to deceive or defraud, such as false offers, invented details of services or demands for payment without anything in return.
Spam or unrelated advertising
Mass, repeated or off-topic advertising and content that only aims to draw attention or links.
Harassment or threats
Insults, harassment, threats or targeted exposure of other people.
Hate or incitement
Content that calls for hatred or violence against people or groups, or demeans them because of origin, religion, sex, disability, age or sexual orientation.
Misleading information
Misleading statements about a person, a business, services, prices or qualifications.
Prohibited goods or services
Offers of goods or services that the law forbids, or that may only be offered with a permit that is missing.
Impersonation
Appearing under the name or identity of another person or business without their permission.
Violation of privacy
Publishing the private data of others, such as address, phone number or photos, without their consent.
Other breach of the terms of use
Any other breach of these terms that no clause above names.
Prices and Payments
Using haiati — including registration, search, contacting others, and publishing provider profiles, marketplace listings, job postings, events, and questions — is currently completely free of charge for both consumers and businesses. Should optional paid add-on services (such as paid highlights) be introduced in the future, they will require prior transparent pricing and an explicit separate order, subject to statutory consumer information and withdrawal rights.
Right of withdrawal (Widerrufsrecht)
Haiati currently offers no paid services. If you enter into a distance contract with us as a consumer in the future, the statutory right of withdrawal under EU Consumer Rights Directive 2011/83/EU and §4 FAGG (Austria) applies, and we will inform you about it before the contract is concluded.
Order of Search Results (Ranking) and Recommendations
On overview and search pages, the following main parameters determine the order of entries (Art. 27 DSA): (1) When a search term is entered, entries are sorted by text relevance (match between query and title, description, category, and specialties across Arabic, German, and English); (2) when a location or radius filter is active, by geographic distance to the selected place; (3) without a search term or radius, by recency (for events by next start time, otherwise by publication date). Entries labeled "Highlighted" appear in a clearly separated section above the list and do not alter the order of regular search results; such highlights are currently selected editorially free of charge. On your home page, the "From your saved searches" section shows only entries matching the search filters you explicitly saved; you can disable this section at any time in your privacy settings.
Your content — license to us
You own everything you post (listings, profiles, reviews, Q&A answers, messages). By posting, you grant Haiati a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content within our service for as long as it's live on the platform. The license ends when you delete the content or your account, except where retention is required by law.
Prohibited content
You may not post content that is illegal, infringes third-party rights, depicts minors in a sexualised way, is hateful toward protected groups, impersonates someone else, contains malware, or spams the community. We remove violations and may suspend accounts at our discretion. Repeat violations lead to permanent bans.
Account termination
You can terminate this user agreement at any time without notice by deleting your account under "Delete account" in your account settings or via the public erasure page. We may temporarily suspend an account or terminate it with 14 days’ notice — or immediately for good cause — in the event of serious or repeated violations of these Terms of Service or applicable law; the procedure and your redress options follow the "Content Moderation" section above. Your statutory data protection rights to access, export, and erasure remain unaffected by any suspension or termination.
Warranty and Liability
Because haiati currently provides its platform services free of charge and acts solely as an intermediary for transactions between users and businesses, we do not warrant uninterrupted availability of the platform or the accuracy, quality, safety, or legality of third-party content, services, goods, job postings, or events. Mandatory statutory warranty rights of consumers remain unaffected. Mahmoud El-Gamal is liable without limitation for damages caused by intent or gross negligence, for injury to life, body, or health (personal injury), and under mandatory product liability law. In cases of slight negligence, liability for pure financial loss, lost profits, data loss, or indirect damages is excluded unless mandatory consumer protection law requires otherwise.
Governing law and venue
These Terms of Service and the contractual relationship are governed by substantive Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-laws rules. If you are a consumer habitually resident in the European Union or another country, mandatory consumer protection provisions of your country of residence remain unaffected under Art. 6(2) of the Rome I Regulation, and you may bring claims before the courts of your habitual residence. For disputes between businesses, the court with subject-matter jurisdiction at the seat of Mahmoud El-Gamal (Wien) has exclusive jurisdiction.
Changes to these terms
We may update these terms when the service, the law, or our business practice materially changes. Non-material edits (typos, clarifications) take effect when published; material changes — new fees, reduced user rights, new data uses — require 30 days' prior notice by email. If you keep using Haiati after a material change takes effect, you accept the new version. If you don't agree, you can delete your account before the change activates, with no penalty.
